Long-haul delay considerations
A Johannesburg-Paris flight is approximately 11 hours. Several specific factors increase delay risk:
- Crew duty hours: long-haul crew time limits can force ground-time on delayed departures (cascading effect).
- Aircraft rotation: a delay on the inbound from Europe automatically delays the outbound.
- Weather in winter (June-August SA, December-February EU): severe weather is possible at either end.
- JNB ATC slot constraints: rare but real.
None of these is automatically extraordinary. The airline must prove specific event documentation.
Compensation does NOT scale with delay duration
Whether your flight is delayed 4 hours or 24 hours, the EC 261 compensation is fixed at €600 per passenger for this route. However, beyond 5 hours, additional rights apply:
- Right to refund: if the delay exceeds 5 hours, you can choose not to take the flight and demand a full refund (article 6.1.c).
- Right to care: meals, refreshments, hotel if overnight wait: entire duration of the delay.
- 2 free phone calls or emails (article 9).
How to claim
- Gather documents: PNR, boarding pass, photo of arrival time at Paris (CDG departure board or your phone).
- Submit online claim on the operating airline's website.
- Wait 30-60 days.
- Escalate to DGAC France or German LBA if refused.
- Court action as last resort: court costs are reimbursed if you win.
What the regulation actually says
Regulation (EC) No 261/2004 is the legal text behind this claim. Here is what it says, article by article:
- Article 5, cancellation: if your flight is cancelled, the airline must offer a refund or rerouting, plus compensation unless you were informed far enough in advance or offered a close rerouting.
- Article 6 and the Sturgeon ruling, long delay: Article 6 covers delay at departure. The CJEU's Sturgeon ruling (C-402/07) extended the right to compensation to any delay of 3 hours or more at final arrival, treating it like a cancellation.
- Article 7, compensation amount: the amount depends on distance, fixed per passenger regardless of ticket price: 250 euros under 1,500 km, 400 euros between 1,500 and 3,500 km, 600 euros above 3,500 km.
- Article 5(3), extraordinary circumstances: the airline's only valid defence. Routine technical issues, crew rotation problems and airport congestion generally do not qualify; a genuinely exceptional event might.
