Amsterdam-Lagos flight delay: claim up to €600 compensation
KLM operates a genuine direct flight between Amsterdam Schiphol and Lagos Murtala Muhammed, one of the busiest corridors between Europe and Nigeria, serving a large share of the Nigerian diaspora in the Netherlands. Delays happen, and on this specific route your rights are unusually clear-cut.
Distance and compensation amount
Amsterdam-Lagos direct = approximately 5,000 km. This places the route in the highest EC 261 bracket: €600 per passenger for a delay of 3 hours or more at final arrival.
For a family of 4: €2,400 in total.
The route, and who operates it
KLM operates this route non-stop, flight numbers KL587 (Amsterdam to Lagos) and KL588 (Lagos to Amsterdam), on an Airbus A330, roughly 6h40 to 6h45 in the air. Because KLM is a Dutch airline, a European Union carrier, EC 261/2004 applies fully in both directions.
EC 261 coverage, direction by direction
| Direction | Airline | Covered by EC 261 |
|---|---|---|
| Amsterdam → Lagos | KLM (or any airline) | ✔ Always, departure from an EU airport |
| Lagos → Amsterdam | KLM | ✔ Yes, European carrier |
| Lagos → Amsterdam | Non-European airline serving the route | ✘ Not under EC 261, Montreal Convention applies instead |
The rule behind this table is simple: a flight departing an EU airport is covered whatever the airline. A flight departing outside the EU is covered only if the operating carrier is European.
Connecting flights
If your ticket is a single booking with a connection, the delay is measured at your final destination (Folkerts ruling, CJEU 2013). A missed connection that makes you arrive 3h+ late still opens the right to compensation, calculated on the total journey distance, even if part of the trip is operated by a different airline.
Cancelled flight: your rights
If the airline cancels your flight and informs you less than 14 days before departure, you are entitled to the €600 compensation per passenger, plus a refund of the ticket OR rerouting, your choice. These two rights are cumulative. A voucher only replaces a cash refund if you accept it: you can refuse it and demand a bank transfer instead.
While you wait: meals, hotel, luggage
Beyond the fixed compensation, Article 9 of EC 261/2004 requires the airline to assist you during the wait on this long-haul route (over 3,500 km): meals and refreshments from 4 hours of delay, hotel and transport if an overnight stay becomes necessary, plus two free calls or emails. Keep every receipt: these actual costs can be claimed on top of the €600, and a meal or hotel voucher the airline hands you is also useful proof of the delay.
For lost, damaged or delayed baggage, the Montreal Convention applies separately: up to roughly €1,800 (1,519 SDR) per passenger. Before leaving the airport, always get the incident recorded and fill in a PIR (Property Irregularity Report) at the airline's desk.
The airline's excuses: valid or not
The airline only escapes compensation in case of an extraordinary circumstance it could not have avoided.
Valid excuses: extreme weather, airspace closure, air traffic control strike, bird strike or runway debris, a hidden manufacturing defect. Even then, the airline still has to prove it took all reasonable measures to limit the delay.
Not valid (compensation remains due):
- a technical fault, even unexpected and even with maintenance up to date (Wallentin-Hermann and van der Lans rulings, CJEU)
- the aircraft's delay on its previous rotation, unless the airline proves an upstream extraordinary cause
- a strike by the airline's own staff (Krüsemann ruling, CJEU)
- understaffing or an organisational issue
How long do you have to claim?
5 years before French courts. A Lagos-Amsterdam flight delayed two or three years ago is still claimable today.
