Three conditions decide your eligibility

Key point: what counts is the delay recorded on arrival, not at departure. A flight that left 2h late but arrived 3h15 late still qualifies for compensation.

Why €400 and not €600 on this route

Martinique is an outermost region of the European Union (Article 349 of the Treaty on the Functioning of the EU). A Paris-Fort-de-France flight is therefore legally an intra-EU flight, just like a Paris-Nice flight. Article 7(1)(b) of EU Regulation 261/2004 caps compensation at €400 for any intra-EU flight over 1,500 km, regardless of the actual distance flown (about 6,800 km between Paris and Fort-de-France). The €600 tier only applies to flights over 3,500 km where one point of departure or arrival is outside the European Union, which is not the case here.

Large family? Compensation adds up per passenger

The price paid for each ticket does not factor in: a promotional fare is entitled to the same fixed amount as a full-fare ticket.

Why €400 and not €600 for a Paris-Martinique flight?
Martinique is an outermost region of the European Union (Article 349 TFEU). A Paris-Fort-de-France flight is therefore intra-EU, capped at €400 by Article 7(1)(b) regardless of the distance flown. The €600 tier only applies to flights over 3,500 km where one point is located outside the European Union.
Are all airlines on Paris-Fort-de-France covered both ways?
Yes. Air France, Air Caraïbes and Corsair are French airlines, so EU carriers, and Martinique is an EU airport: coverage applies outbound and return.
The airline refused my claim, can I still make a claim?
Yes. A refusal does not extinguish the claim. Many refusals rest on extraordinary circumstances that do not qualify as such under Court of Justice of the European Union case law. An already-refused case can still be reviewed.
Does travelling as a family to Martinique increase the amount?
Yes, compensation is due per passenger. A family of four represents up to €1,600, a family of six up to €2,400, regardless of the price paid for each ticket.
How far back can I claim for an old Martinique flight?
In France, the claim is time-barred after five years from the day the rights holder knew, or should have known, the facts allowing them to act (Article 2224 of the Civil Code). A 2022 flight therefore remains claimable until 2027.
Do I have anything to pay or advance?

Do a strike or a technical fault cancel my rights?
Not automatically. A routine technical fault or an aircraft arriving late from its previous flight generally do not exempt the airline. An internal strike by the airline's own staff does not exempt it either, unlike an air traffic controllers' strike. The exact cause must be verified.
