The delay must be attributable to the airline. A genuinely extraordinary circumstance exempts it; a routine technical fault or a knock-on effect on the aircraft's rotation does not.
Key point: what counts is the delay recorded on arrival in Lagos, not at departure. A flight that left 2h late but arrived 3h15 late still qualifies for compensation.

Nigeria is neither UEMOA nor CEMAC: unlike Senegal, Cameroon or Côte d'Ivoire, Nigeria does not belong to either of the two regional economic unions with their own passenger regulation. For a Europe-Lagos flight, only EU Regulation 261/2004 applies: covered both ways on an EU carrier (Air France, Lufthansa), covered only on the outbound leg on a non-EU carrier.
Large family? Compensation adds up per passenger
Compensation is due per passenger, never per booking. On a Europe-Lagos flight delayed more than 3 hours, a family of four represents €2,400, and a family of six €3,600. The price paid for each ticket does not factor in: a promotional fare is entitled to the same fixed amount as a full-fare ticket.

Is Nigeria part of UEMOA or CEMAC?
No. Nigeria belongs to neither UEMOA (West African CFA franc zone) nor CEMAC (Central African CFA franc zone): it is an English-speaking country with its own framework, distinct from these two unions. For a Europe-Lagos flight, only EC 261/2004 applies.
Is a Lagos-London flight covered by EC 261?
No, not by the European EC 261/2004: since Brexit, the United Kingdom applies its own UK261 regulation, similar in its logic but distinct from the European text.
Is my Lagos-Paris flight with Air France covered both ways?
Yes. Air France is an EU carrier: EC 261/2004 applies both outbound and on the return, unlike a non-EU carrier which would only be covered departing the European Union.
The airline refused my claim, can I still make a claim?
Yes. A refusal does not extinguish the claim. Many refusals rest on extraordinary circumstances that do not qualify as such under Court of Justice of the European Union case law. An already-refused case can still be reviewed.
Does travelling as a family to Lagos increase the amount?
Yes, compensation is due per passenger. A family of four represents up to €2,400, a family of six up to €3,600, regardless of the price paid for each ticket.
How far back can I claim for an old Lagos flight?
In France, the claim is time-barred after five years from the day the rights holder knew, or should have known, the facts allowing them to act (Article 2224 of the Civil Code). A 2022 flight therefore remains claimable until 2027.
